Odisha Govt Eases Pre‑RERA Apartment Registration

The Odisha Government has issued a special order to ease apartment registration for housing projects completed before the Real Estate (Regulation and Development) Act (RERA) came into force on October 5, 2016.

This exemption mechanism, published in the Odisha Gazette, provides relief to homebuyers, landowners, and promoters who faced long‑pending registration hurdles in pre‑RERA projects.

Under the new framework, projects must meet specific eligibility conditions: they should have been completed before October 5, 2016, with at least 50% of apartment units registered before the RERA cut‑off date, and must be part of an approved building plan under state laws.

Promoters and landowners are required to display approved building plans, obtain a No Objection Certificate (NOC) from the Association of Allottees before registering unsold apartments, and furnish compliance undertakings to the Registering Authority.

The order clarifies that this exemption does not regularise unauthorised constructions.

Sale deeds must also ensure transfer of proportionate undivided interest in common areas to the Association of Allottees.

Officials say the move strengthens urban housing governance and resolves legacy property registration issues, offering long‑awaited relief to thousands of stakeholders across Odisha.
