Supreme Court Ensures Equal Pension for Retired High Court Judges

Supreme Court Equal Pension Ruling

( OT Webdesk) New Delhi, May 19, 2025 — In a landmark decision, the Supreme Court of India has ruled that all retired High Court judges are entitled to equal pension benefits, irrespective of their mode of appointment or tenure.

This ruling, rooted in the principle of “One Rank One Pension,” aims to eliminate financial disparities and uphold judicial dignity post-retirement.

A bench led by Chief Justice BR Gavai, alongside Justices AG Masih and K Vinod Chandran, directed the Union of India to pay ₹15 lakh annually to retired High Court Chief Justices and ₹13.5 lakh annually to retired High Court judges, including those who served as additional judges.

The judgment further ensures that widows and family members of deceased judges will receive family pensions and gratuity benefits, reinforcing financial security for retired members of the judiciary.

Legal experts have hailed this ruling as a monumental step towards maintaining judicial independence and ensuring fair treatment for retired judges.

Additionally, allowances such as leave encashment, pension commutation, and provident funds will now be granted without discrimination.

With this verdict, the Supreme Court reiterates its commitment to upholding justice, not just in the courts but in the lives of those who have dedicated themselves to the judiciary.
